Combiner dans un même ouvrage finance et droits de l'homme peut sembler étrange, en raison de la distance apparente qui sépare ces deux mondes. Mais les apparences sont trompeuses : les droits de l'homme influencent la vie des affaires, bien que de manière indirecte. Il suffit de penser aux mesures gouvernementales telles que les embargos financiers, la réglementation des « fonds vautours » ou les nombreuses règles de respect de la vie privée que les institutions financières doivent prendre en considération dans leurs activités quotidiennes. Les institutions financières sont également confrontées aux changements et aux nouvelles priorités de la société qui les conduisent à mener leurs affaires d'une manière plus respectueuse des droits de l'homme. Cet ouvrage propose, dans ce contexte, une synthèse de l'influence croissante des droits de l'homme sur le monde financier.
Finance and human rights may be an unusual combination for a book theme, considering the apparent distance between both worlds. But appearances are deceiving : human rights law does impact the financial world, albeit in an indirect way. Just think about governmental measures such as financial embargoes, the regulation of vulture funds or the many privacy rules with which financial institutions have to cope in their daily activities. Financial institutions are also confronted with the societal changes and new priorities which drive them to undertake their business in a more human rights-compliant way. This book attempts to provide a synthesis of the growing impact of human rights law on the financial world.
De combinatie van financiën en mensenrechten lijkt heel ongewoon als thema voor een boek, aangezien deze twee werelden schijnbaar ver uit elkaar liggen. Maar schijn bedriegt : de mensenrechtenwetgeving heeft wel degelijk een invloed op de financiële wereld, zij het op een indirecte manier. Denk maar aan overheidsmaatregelen zoals financiele embargo's, de reglementering van aasgierfondsen of de talrijke privacywetten waarmee financiële instellingen rekening moeten houden in hun dagelijkse activiteiten. Financiële instellingen worden ook geconfronteerd met maatschappelijke veranderingen en nieuwe prioriteiten die hen ertoe aanzetten hun zaken met meer aandacht voor de mensenrechten af tehandelen. Dit boek tracht, tegen deze achtergrond, een synthese te maken van de groeiende invloed van de mensenrechtenwetgeving op de financiële wereld.
